Terms and Conditions

These Terms & Conditions (“Agreement”) establish a legal agreement between you and TransactCare LLC (“TransactCare”, “we”, “us”, and the like) for the TransactCare products or services provided to you as described herein, which include access to computer software and may include associated media, online or electronic documentation, on-line bill review and payment services provided for the benefit of a designated healthcare facility, and internet-based services (collectively, “Services”). YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT AND BY USING THE SERVICES. IF YOU DO NOT AGREE TO ANY TERM OR CONDITION IN THIS AGREEMENT, DO NOT USE THE SERVICES.

Please read this Agreement carefully before accessing or using the Services. By accessing or using the Services, you agree to be bound by the terms and conditions below. If you do not accept the terms and conditions of this Agreement, you may not access or use the Services. TransactCare may modify this Agreement from time to time, and such modifications shall be effective immediately upon posting of the modified Agreement. By continuing to access or use the Services following such modifications, you agree to be bound by the modified Agreement. TransactCare has no obligation to notify you of the posting of a modified Agreement.

Payment Services 

By accessing the Services, you authorize us (i) to establish and maintain your payment authorizations, and (ii) to process your payments according to your instructions.  You may be asked to supply certain information relevant to your purchase of Services including, without limitation, your bank account information, your credit card number, the expiration date of your credit or debit card, your billing address, and your shipping information.

Types of Payments and Payees

You may use the Services only to authorize the payment of bills owing the designated healthcare facility that TransactCare is authorized to provide payments acceptance services for.   Payments that you authorize will be made from a bank or financial institution account or other payment account that you designate. It is your responsibility to establish and maintain appropriate transaction payment accounts and to pay any and all fees associated with these accounts.    You represent and warrant that: (i) you have the legal right to use and access any bank account, credit or debit card(s) or other payment method(s) in connection with any transaction initiated through us; and that (ii) the information you supply to us is true, correct and complete.

Timing

By providing TransactCare with a payment authorization under the Services, you authorize us to charge your account to remit funds on your behalf to pay your bills owed to the designated healthcare facility  It is your responsibility to make timely payment authorizations, so that the funds will arrive at TransactCare before the date on which they are due. You should submit all payment authorizations to TransactCare at least three business days before the actual due date so that bill payment is not late. A business day means any day other than Saturday, Sunday, a federal holiday, or any other day on which banks in the United States are not generally open for business. You shall bear the risk and the responsibility for paying any late charges or penalties resulting from the late receipt of any payment made under the Services provided. 

Responsibility of TransactCare

TransactCare will use reasonable efforts to process all your payment authorizations promptly and properly, provided the authorizations are actually received by TransactCare. TransactCare will not be responsible for any failure to process a payment authorization that is not actually and completely received by TransactCare for any reason, including user error, equipment malfunction, natural disasters or impediments, or inaccurate or incomplete information.

Bank or Financial Institution Limitations

In using the Services, you are requesting us to make payments for you from your designated account. If your bank or financial institution is unable to process a transaction for any reason (i.e., there are insufficient funds in the account to cover the transaction, or funds in the account are unavailable for any reason), the transaction may not be completed. There may be limits or restrictions upon the number or frequency of payments that may be made from your transaction account under applicable law or under the terms of your agreement with the bank or financial institution maintaining your transaction account.

TransactCare’s obligations under the Service are subject to any such limits or restrictions, and TransactCare has no duty to notify you of any such limits or restrictions.
